      4.4 Website analysis

In order to analyse and optimise our websites, we use various services, which are described below. For example, we can analyse how many users visit our site, what information is most in demand or how users find the services. Among other things, we gather data about the website from which a data subject came to a website (so-called referrer), which subpages of the website were accessed or how often and for how long a subpage was viewed. This helps us to design and improve our offerings in a user-friendly way. The data collected is not used to personally identify individual users.
Google Analytics. If you have given your consent, this website uses Google Analytics, a web analysis service of Google LLC. The competent service provider in the EU is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").
Google Analytics uses cookies that enable an analysis of your use of our website. The information collected by means of cookies about your use of this website is generally transferred to a Google server in the USA and stored there. We use the User-ID function. The User ID allows us to assign a unique, permanent ID to one or more sessions (and the activities within those sessions) and to analyse user behaviour across devices.

We use Google signals. This allows Google Analytics to collect additional information about users who have activated personalised advertisements (interests and demographics), and advertisements can be delivered to these users in cross-device remarketing campaigns.

We use the function 'anonymizeIP' (so-called IP-Masking): As a result of the activation of IP anonymisation on this website, your IP address will be truncated by Google within member states of the European Union or in other signatory states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the USA and truncated there. The IP address forwarded by your browser as part of Google Analytics is not merged with other data from Google.

During your visit to our website the following data, among others, is collected:

      • the pages you call up, your ‘click path’
      • Achievement of ‘website objectives’ (conversions, e.g. newsletter registrations, downloads)
      • Your user behaviour (e.g. clicks, time spent, bounce rates)
      • Your approximate location (region)
      • Your IP address (in truncated form)
      • technical information about your browser and the devices you use (e.g. language settings, screen resolution)
      • Your Internet provider
      • the referrer URL (via which website/advertising medium you came to this website)

      Purposes of processing

On behalf of the operator of this website, Google will use this information to evaluate your use of the website and to compile reports on website activities. The reports provided by Google Analytics are used to analyse the performance of our website and the success of our marketing campaigns.

      Recipient

The recipient of the data is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland as processor. For this purpose we have concluded a processing contract with Google. Google LLC, based in California, USA, and, where applicable, US authorities may have access to the data stored by Google.

      Storage period

The data sent by us and linked to cookies will automatically be deleted after 14 months. Data whose retention period has expired is automatically deleted once a month. You can also prevent the data generated by the cookie and related to your use of the website (including your IP address) from being sent to Google and the processing of this data by Google by

      1. not giving your consent to the setting of the cookie or
      2. download HERE and install the browser add-on to disable Google Analytics.

You can also prevent the storage of cookies by adjusting your browser software accordingly. However, if you configure your browser to reject all cookies, you may experience limited functionality on this and other websites.

The legal basis and possibility of revocation for this data processing constitutes your consent, Art. 6 para. 1 lit. a) GDPR. You can revoke your consent at any time with effect for the future by calling up the cookie settings in our Consent Management Platform (fingerprint displayed at the bottom left) and changing your selection there. Within the framework of Google Analytics, we inform you that the IP address is truncated within member states of the European Union or in other states that are party to the Agreement on the European Economic Area, and only in exceptional cases is the IP address transmitted in full to a Google server in the USA and truncated there. The IP address is not linked with your data as part of other offers from Google.

Google may also combine the aforementioned information with information from other sources. When you subsequently visit other websites, you may be shown advertisements tailored to your interests.

We process your data pseudonymously as part of the Google marketing services. This means that Google does not store and process your name or email address, for example, but processes the relevant data cookie within pseudonymous user profiles. The information collected by Google marketing services about users is transmitted to Google and stored on Google's servers in the USA.

The Google marketing services we use include the online advertising program ‘Google Ads’ (formerly known as ‘Google AdWords’). In the case of Google Ads, each ad customer receives a different ‘conversion cookie’. Cookies can therefore not be tracked via the websites of Ads customers. The information collected using the cookie is used to compile conversion statistics for ads customers who have opted for conversion tracking. Ads customers are told the total number of users who clicked on their advertisement and were redirected to a page with a conversion tracking tag. However, they will not receive information that can be used to identify users personally.
We also use the ‘Google Tag Manager’ to integrate and manage the Google analysis and marketing services on our website.

This service can forward the collected data to another country. Please note that this Service may transfer data outside the European Union and the European Economic Area and to a country that does not offer an adequate level of data protection. If the data is transferred to the US, there is a risk that your data may be processed by US authorities for control and monitoring purposes without your having any right of legal remedy. The following is a list of the countries to which the data is transferred. This can be for various purposes, such as storage or processing.

      5. Registration on this website

You can login/register in certain areas of our website to take advantage of additional features on the site. We use the data entered for this purpose only for the purpose of taking advantage of the respective offer or service for which you have registered – for example, to register for an event or to download an information brochure. The compulsory information requested on registration must be provided in full. Otherwise we can decline registration. For important changes, such as changes to the scope of the offer or technically necessary changes, we use the email address provided during registration to inform you in this manner.

The data entered during registration is processed on the basis of your consent (Art. 6 para. 1 lit. a) GDPR). You can revoke any consent you have provided at any time. Just send us an informal message by email. The legality of the data processing already carried out remains unaffected by the revocation.

The data collected during registration is stored by us for as long as you are registered on our website and is then deleted. Legal retention periods remain unaffected.

      6. Newsletter

      General information

You can subscribe to newsletters on some of our websites, in which we inform you about the activities of the proALPHA Group, current information about our services, special offers, promotions and events. The content of the individual newsletter will be briefly described during registration. The legal basis for forwarding the respective newsletter is your consent in accordance with Art. 6 para. 1 lit. a) GDPR in conjunction with § 7 paragraph 2 no. 3 UWG or the statutory authorisation according to § 7 paragraph 3 UWG.

We use the so-called double-opt-in procedure for registering for our newsletters. This means that once you have registered, we will send you an email to the email address provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be automatically deleted after three days.

This information is used to contact you personally. After your confirmation we save your email address for the purpose of sending the newsletter and until you withdraw your consent. We also store your current IP address at the time of registration, the time of registration and the confirmation for up to three years after registration (limitation period). The purpose of this procedure is to be able to verify your registration in case of doubt and, if necessary, to clarify any misuse of your personal data. The legal basis for the logging of the registration is our legitimate interest in accordance with Art. 6 para. 1 letter f) GDPR based on verification of previously given consent, see also Art. 7 para. 1 GDPR.

You can revoke your consent to receive the newsletter at any time and cancel the newsletter. You can withdraw your consent by clicking on the link provided in each newsletter email or by sending an email to info@proalpha.com.

      Newsletter tracking

We would like to point out that when the newsletter is sent, we evaluate your user behaviour to determine whether and when the newsletter was opened. For this evaluation, the emails sent contain so-called web beacons or tracking pixels, which are stored on our server and are loaded when the newsletter is opened. Technical information such as browser type, time of opening and IP address are conveyed. For evaluation purposes, we link the above-mentioned data and the web beacons with your email address and an individual ID. Links received in the newsletter also contain this ID and enable us to analyse your click behaviour.

We use the data thus obtained to create a user profile in order to tailor the newsletter to your individual interests. We record when you read our newsletters, which links you click on, and from this we deduce your personal interests. We link this data to actions performed by you on our website. The legal basis for this data processing is your consent, Art. 6 para. 1 letter a) GDPR.

You can revoke your consent at any time with effect for the future. In this case, the revocation covers the entire newsletter, as a separate revocation of the tracking is unfortunately technically not possible. To do so, simply click on the unsubscribe link provided in each email.

Such tracking is also not possible if you have deactivated the display of images by default in your email program. In this case, the newsletter will not be displayed completely, and you may not be able to use all functions. If you display the images manually, the above tracking is performed. The information from the tracking is stored as long as you have subscribed to the newsletter. After deregistration, the data is made anonymous and used for purely statistical purposes. The data you provide us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel the newsletter. Data that has been stored by us for other purposes remains unaffected.

      7. Applications

You can apply online via our application portal at https://jobs.proalpha.com/de. Your online application will be forwarded directly to the personnel department via an encrypted connection and of course treated confidentially.

Should you nevertheless apply to us by email, we expressly point out that sending unencrypted emails or email attachments is not secure. Your details will be used for the processing of your application and the decision on whether to establish an employment relationship. The legal basis is § 26 (1) in conjunction with para. 8 sentence 2 BDSG. Furthermore, your personal data may be processed to the extent that this should be necessary to defend against legal claims asserted against us in the application process. The legal basis for this is Art. 6 para. 1 lit. f) GDPR. The stated purposes also constitute a legitimate interest in the processing.

In the event of an employment relationship between you and us, we may, in accordance with Section 26 (1) BDSG, further process the personal data already received from you for the purposes of the employment relationship if this is necessary for the implementation or termination of the employment relationship or in order to exercise or fulfil the rights and obligations of employee representation arising from a law or a collective agreement, works or service agreement (collective agreement).

Your application data will not be processed beyond the usage described above. Your personal data will be deleted at the latest after 6 months after completion of the application procedure, provided that no other legitimate interests on our part stand in the way of deletion or you have not given us permission for longer storage. Other justified interests in this sense are, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

      8. Data transmission and recipients or categories of recipients

As a matter of principle, your data will not be transferred to third parties, unless we are legally obliged to do so, or the transfer of data is necessary for the execution of the contractual relationship, or you have expressly consented to the transfer of your data beforehand.

      9. Period of storage

Personal data that we collect will be deleted when the purpose of the processing ceases or within the legal retention periods.

In the event of your objection, we will no longer process your personal data unless we can prove compelling reasons for processing warranting protection that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

      11.3. Rights regarding direct advertising

If we process your personal data in order to carry out direct advertising, you have in accordance with If we process your personal data for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing, including profiling, in so far as it is connected with such direct marketing, in accordance with Art. 21 paragraph 2 GDPR. If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.

11.4. Right of appeal to a supervisory authority

You also have the right to complain to a competent data protection supervisory authority about the processing of your personal data by us.

      12. Contact by email or contact form

When you contact us by email or via a contact form, the data you provide (e.g. your email address or your first and last name) will be stored by us to answer your questions. Insofar as we request information via our contact form that is not required for making contact, we have always marked this as optional. This information enables us to clarify your query and to improve the processing of your concern. Any communication of this information is made expressly on a voluntary basis and with your consent, Art. 6 para. 1 lit. a) GDPR. If this involves information on communication channels (e.g. email address, telephone number), you also agree that we may contact you via this communication channel in order to respond to your request. You can of course revoke this consent at any time with effect for the future.

We delete the data accumulated in this context after storage is no longer required or restrict processing if there are legal storage obligations.

      13. Data security

We have taken extensive technical and operational precautions to protect your data from accidental or deliberate manipulation, loss, destruction or access by unauthorised persons. Our security procedures are regularly reviewed and adapted to technological progress.

      14. Data transfer and intended data transfer to a third country or international organisation

As a general rule, your data will not be transferred to third parties unless we are legally obliged to do so, or the transfer of data is necessary for the execution of the contractual relationship, or you have previously consented to the transfer of your data.
